Terms and Conditions of Sale and Delivery

1 General

DTS GmbH (hereinafter: Seller) sells and delivers exclusively in accordance with the following Terms and Conditions of Sale and Delivery.

2. orders

Our presentation of goods in our online shop does not constitute an offer, but a non-binding invitation to the customer to order. By ordering the goods, the customer makes a binding contractual offer. The vendor shall confirm receipt of an order by electronic means without delay. The receipt of an electronic order does not constitute a binding acceptance by the seller. The vendor is authorised to accept the customer's binding offer within 3 working days of receipt of the customer's order. The text of the contract will be saved by us and sent to the customer by email together with the legally binding GTC.

3. Delivery

Ordered goods will be dispatched to the customer within 3 working days of our acceptance of the offer at the latest. Should there be a delay in delivery, we will inform the customer immediately of the delivery date. There are no delivery restrictions.

4. warranty

The warranty period for all warranty claims, with the exception of the customer's claims for damages, is one year from delivery of the goods for the sale of used goods.

5 Liability

We exclude our liability for our own behaviour and that of our vicarious agents for slightly negligent breaches of duty. This exclusion of liability does not apply to claims based on injury to life, limb or health, guarantees or claims arising under the Product Liability Act. The exclusion of liability also does not apply to slightly negligent breaches of material obligations, the fulfilment of which is essential for the proper performance of the contract.
In cases of slightly negligent breach of material obligations, our liability is limited to the amount of typical damages for comparable transactions of this type that were foreseeable at the time the contract was concluded or at the latest when the breach of duty was committed.

6. duty of care

The buyer must ensure that all modifications and conversions to his vehicle, if it is used on public roads, are entered in his vehicle documents (vehicle registration document and vehicle licence) in accordance with the statutory provisions. If necessary, the buyer must present the vehicle to the Technical Inspection Association (TÜV). The responsibility for the TÜV registration of converted vehicles or their parts lies with the buyer.

7. retention of title

The seller retains ownership of the goods sold by her until full payment of the purchase price.

8. prices and terms of payment

The delivery / dispatch of the goods takes place exclusively against payment in advance (advance transfer), PayPal, credit card or cash payment on collection. The seller's prices are to be understood as final prices including VAT, plus any shipping costs. The amount of the shipping costs can be found in the shipping costs section.

Consumers have a right of cancellation. Details can be found under the heading Right of cancellation. If you make use of your right of cancellation, the agreement that you will bear the direct costs of the return shipment, regardless of the price of the item to be returned, applies in accordance with Section 357 (6) BGB (new version). Offsetting against disputed or not legally established claims of the customer is excluded.

9. Place of jurisdiction and choice of law

For all disputes arising from or in connection with the contracts between the seller and merchants as well as between the seller and persons who do not have their domicile or habitual residence within the scope of the German Code of Civil Procedure, the place of jurisdiction shall be the registered office of the seller

The legal relationship between the seller and the customer shall be governed by the laws of the Federal Republic of Germany.br>The legal relations between the seller and the buyer arising from or in connection with this contract shall be governed by the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

All prices are final prices in euros including statutory VAT. Shipping costs are added, which you can find under the heading shipping costs.
